The San Diego Divorce Process

Following the initial filing of a Dissolution of Marriage petition in San Diego, a hearing addressing specific issues is scheduled. At this hearing, matters such as child custody and support are arranged and temporarily ordered.

What follows is known as the "Discovery" process where both parties are to share information about income, assets, debts and other related matters. The discovery process generally includes the taking of depositions and other inquiries into the history of the marriage. After the discovery process is completed, the parties and their respective San Diego divorce attorneys (if the parties are represented) will discuss settlement of the case.

If at this point both parties have been able to reach an agreement on the issues pertaining to the divorce (child support, child custody, spousal support, division of property), then a settlement agreement is prepared. This agreement is signed by both parties and then submitted to the courts for final approval. If the parties are unable to reach an agreement regarding all of the issues, then generally the courts will recommend that mediation take place. If the issues still cannot be resolved after mediation, then the case will move directly to trial.

At divorce trials, San Diego divorce attorneys will present their best case on behalf of their client. The court will consider all relative evidence and then issue a settlement order that addresses all issues. Both parties are then legally obliged to follow any orders that the courts impose. The length of the divorce process varies from one case to the next. However, a minimum of six months and a day must have passed since the filing of the Dissolution of Marriage petition before an order will be issued dissolving the marriage.
