San Diego Spousal Support Attorney

Spousal support (also referred to as alimony) is the financial support that is provided by one ex-spouse to the other. Either party of the failed marriage may seek to receive spousal support.

Typically, spousal support is awarded to the spouse whose income is comparatively lower than the other spouse's. California courts have broad discretion in ascertaining the amount of spousal support to be paid as well as how long it will be paid. Some California counties have adopted guidelines to follow which suggest an appropriate range of spousal support to be paid on a temporary basis. If neither divorcing party needs spousal support at the time of the dissolution of marriage, the parties can request that "reserve judgement" on the issue be in place. This means that if the needs of one of the parties have changed, he or she may go back to courts and make a request for spousal support.

California laws provide that spousal support be based on a number of factors. Some of these factors are: the standard of living that was enjoyed during the marriage, the incomes or earnings (or even potential earnings) of the parties, the extent to which the supported spouse contributed to the attainment of an education or professional license by the other spouse, and whether or not there are any young children in the home. It should be noted that child support payments do take precedence over spousal support. The amount of spousal support can be up to 40% of the paying spouse's net income (less any child support that is being paid), and less than 50% of any net income that the supported spouse may have.
